Melanie Hart is a leading practitioner in the area of labour and employment in South Africa. Acting for employers in the mining, engineering, construction, financial services, aviation and medical sectors, she has particular expertise in collective bargaining disputes within the mining industry.
Recently recognised by Best Lawyers as a leading employment lawyer for 2023 and the 2023 edition of Legal 500 for employment law and mining, her breadth and depth of experience includes all aspects of employment law. Chantal has 10 years’ experience in mining, infrastructure, and natural resources sector. Her focus is on mining regulatory compliance, high court litigation and commercial law. She has assisted most of the major role players in the mining industry over the years and is particularly passionate about advising on all matters relating to the MPRDA and has advised several clients on various regulatory matters in that regard. Chantal has also assisted clients with submissions made in response to notices / directives issued in terms of section 47 and section 93 of the MPRDA and has advised on the processes to be followed in respect of various applications made in terms of the MPRDA (including applications in terms of section 11, section 53 and section 102).
Chantal also has extensive experience in conducting legal due diligence investigations on mining operations and assets as well as drafting of various commercial agreements in relation to the disposal and acquisition of such assets.
She has also assisted several clients with the submission and successful processing of internal appeals to various regulatory authorities (including the DMRE, the DFFE and the Water Tribunal).
Chantal is also a keen litigator and has initiated and conducted court proceedings for a number of mining houses on a variety of matters, including shareholders’ disputes, claims arising in terms of complex commercial agreements and obtaining interdictory relief against community members who unlawfully disrupt mining operations.
